# Terms of Service for fiSHed

## 1. Acceptance of Terms
By downloading, installing, or using fiSHed (“the App”), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
## 2. Description of Service
fiSHed is a fishing application that provides:
– Fish species information and regulations
– Catch logging with photos and environmental data
– Location-based mapping and hotspot identification
– Fishing intelligence and analytics
– Community features and social interactions
– Weather, tide, and marine conditions
– Voice-activated AI assistant (Spanner) for fishing regulations
– Premium subscription features
## 3. User Accounts
### Account Creation
– You must provide accurate, current information
– You are responsible for maintaining account security
– You must be 13+ years old to use the App
– One account per person
### Account Security
– Keep your password confidential
– Notify us immediately of unauthorized access
– You are responsible for all activity under your account
### Account Termination
– You may delete your account at any time via Settings
– We may suspend/terminate accounts for Terms violations
– Termination does not entitle refunds for unused subscription time
## 4. User Content
### Your Responsibilities
You are solely responsible for content you post, including:
– Catch photos and descriptions
– Community posts and comments
– Profile information
– Equipment details
### Prohibited Content
You may NOT post content that:
– ❌ Is illegal, harmful, or threatening
– ❌ Infringes intellectual property rights
– ❌ Contains viruses or malicious code
– ❌ Is false, misleading, or fraudulent
– ❌ Harasses, bullies, or threatens others
– ❌ Contains personal information of others without consent
– ❌ Promotes illegal fishing practices
– ❌ Contains spam or unsolicited advertising
– ❌ Is sexually explicit or obscene
– ❌ Violates fishing regulations or promotes poaching
### Content Ownership
– You retain ownership of your content
– You grant us a license to use, display, and distribute your content within the App
– Public catches may be visible to other users on the Billboard
– We may use anonymized catch data for analytics and features
### Content Moderation
– We reserve the right to remove any content that violates these Terms
– We may (but are not obligated to) moderate user content
– Repeated violations may result in account termination
## 5. Fishing Regulations
### Important Disclaimer
– Fishing regulations are **informational only**
– Regulations may be outdated or incorrect
– **YOU are responsible for verifying current regulations** with official sources
– Regulations vary by location, season, and species
– Always check Queensland Fisheries (or local authority) before fishing
### Your Responsibility
– Comply with all local, state, and federal fishing laws
– Obtain required fishing licenses
– Follow size limits, bag limits, and closed seasons
– Practice ethical and sustainable fishing
### No Liability
We are NOT responsible for:
– Fines or penalties from fishing violations
– Inaccurate or outdated regulation information
– Misinterpretation of regulations
## 6. Location Services
### GPS Data
– Fishing Mode and catch logging use your device’s GPS
– Location data is used to provide conditions, map catches, and identify hotspots
– You can disable location services in device settings
– Some features require location to function
### Location Privacy
– Your exact catch locations are **private by default**
– Only you can see precise GPS coordinates
– Public catches show general area only
– Hotspots are aggregated and anonymized
## 7. Premium Subscription
### Subscription Details
– **Auto-Renewal:** Automatically renews monthly unless cancelled
– **Payment:** Charged to your Apple ID account
– **Billing:** Charged at confirmation of purchase, then monthly on the same date
### Premium Features
– ✅ Ad-free experience
– ✅ Upload up to 10 photos per catch (vs. 3 for free)
– ✅ Priority customer support
– ✅ Future premium features as added
### Managing Subscription
– Manage via: iOS Settings > [Your Name] > Subscriptions
– Cancel anytime before next billing cycle
– Cancellation takes effect at end of current period
– No refunds for partial subscription periods
### Free Trial (If Offered)
– If a free trial is offered, terms will be displayed at sign-up
– Trial converts to paid subscription unless cancelled before trial ends
– Only one trial per user/account
### Price Changes
– We may change subscription prices with 30 days notice
– Existing subscribers maintain current price until next renewal after notice
## 8. Advertisements
### Non-Premium Users
– Free users see advertisements via Google AdMob
– Ads help support app development and maintenance
– Ads may be targeted based on app category and general location
### Premium Users
– Premium subscribers see no advertisements
– Ad removal is a key premium benefit
## 9. Intellectual Property
### Our Rights
All App content (excluding user content) is owned by us:
– App design, code, and features
– Fish database and information
– Logos, trademarks, and branding
– Icons, graphics, and visual elements
### Your License
We grant you a limited, non-exclusive, non-transferable license to:
– Use the App for personal, non-commercial purposes
– Access features you’re entitled to (free or premium)
### Restrictions
You may NOT:
– ❌ Copy, modify, or reverse engineer the App
– ❌ Remove copyright or trademark notices
– ❌ Create derivative works
– ❌ Use the App for commercial purposes without permission
– ❌ Extract or scrape fish database
– ❌ Resell or redistribute the App
## 10. Disclaimer of Warranties
### “AS IS” Basis
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND:
– ❌ No guarantee of accuracy, reliability, or availability
– ❌ No guarantee the App will be error-free or uninterrupted
– ❌ No guarantee of specific results or success
– ❌ No guarantee of data accuracy (weather, tides, fish info)
### Use at Your Own Risk
– Fishing is an outdoor activity with inherent risks
– Check weather and safety conditions before fishing
– Use common sense and proper safety equipment
– We are not responsible for accidents, injuries, or losses
## 11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
We are NOT LIABLE for:
– Indirect, incidental, or consequential damages
– Loss of profits, data, or fishing opportunities
– Fishing fines or violations
– Personal injury or property damage
– Reliance on App information
– Service interruptions or data loss
– Third-party actions or content
**Maximum Liability:** Our total liability is limited to the amount you paid in the past 12 months
## 12. Indemnification
You agree to defend, indemnify, and hold us harmless from claims arising from:
– Your use of the App
– Your violation of these Terms
– Your violation of laws or regulations
– Your content or actions
– Infringement of third-party rights
## 13. Third-Party Services
The App integrates with:
– Firebase (Google) – hosting, authentication, storage
– AdMob (Google) – advertising
– RevenueCat – subscriptions
– Algolia – search
– Weather/Tidal APIs – environmental data
These services have their own terms and privacy policies. We are not responsible for third-party services.
## 14. Changes to Terms
– We may update these Terms at any time
– Changes posted in-app with new “Last Updated” date
– Continued use after changes constitutes acceptance
– Material changes will be communicated via email or notification
## 15. Termination
### By You
– Delete account anytime via Settings
– Cancelling subscription retains access until period ends
– Deleted data is removed per Privacy Policy
### By Us
We may suspend/terminate your account for:
– Violation of these Terms
– Illegal activity
– Abuse or harassment
– Fraudulent behavior
– Extended inactivity (1+ years)
### Effect of Termination
– Access to App immediately revoked
– No refunds for unused subscription time
– User content may be deleted
– These Terms survive termination where applicable
## 16. Governing Law
These Terms are governed by the laws of **Queensland, Australia**.
Disputes will be resolved in Queensland courts.
## 17. Dispute Resolution
### Informal Resolution
Contact us first to resolve disputes informally: support@fished.com.au
### Arbitration (Optional)
If informal resolution fails, disputes may be resolved through arbitration in Queensland.
### Class Action Waiver
You agree to resolve disputes individually, not as part of a class action.
## 18. Severability
If any provision is found invalid, the remaining Terms remain in effect.
## 19. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and fiSHed.
